Welcome to intelecom.org (“Website”). INTELECOM Intelligent Telecommunications, doing business as Intelecom Learning (hereinafter”INTELECOM”), owns and operates this Website and provides it as a service, subject to the terms and conditions set forth below.

Acceptance of Terms
The following terms of use (“TOU”) apply to all visitors to the Website (“Users”). By accessing and/or using the Website, you agree to be bound by these TOU. Any and all use of the Website constitutes an agreement by Users to abide by these TOU. If you do not wish to be bound by any of these TOU, please exit the Website immediately.

Description of Services
INTELECOM provides Users with access to a variety of online resources and services. From time to time materials or services will be amended, added to, or deleted from the Website. Any materials or services as may be added to the Website, or amended, shall be subject to these TOU.

The Website contains copyrighted material that is owned and controlled by INTELECOM and protected by international copyright law, including original content developed for performance or display as part of mediated instructional activities transmitted via digital networks. Users acknowledge and agree that the Website in its entirety, and all material, information, text, graphics, photos, logos, video, audio, animations, electronic art, and other matter contained in the Website (hereinafter referred to as the “Content”), are owned and controlled under copyright by INTELECOM and/or licensed to INTELECOM for its authorized use by third-party providers. Except as expressly authorized in writing by INTELECOM or third party providers, Users may not copy, reproduce, publish, distribute, download, broadcast, transmit, modify, create derivative works of, rent, sell, lease and/or otherwise exploit or use the Content in any manner whatsoever. Users who enter or otherwise provide material to the Website are solely responsible for the content of that material. INTELECOM retains the right, in its sole discretion, to review, edit or delete from the Website any third-party material it receives that it deems illegal, offensive or inappropriate.

INTELECOM Intelligent Telecommunications, Intelecom Learning, INTELECOM Online Resources Network and Crossroads Cafe are registered trademarks or service marks of INTELECOM.

Links to Third Parties
INTELECOM may provide links to third parties on the Website. Users acknowledge and agree that INTELECOM is not responsible for the contents of any linked site or any updates or changes that may be made to such sites. INTELECOM provides these links as a convenience to Users; to promote distribution and implementation of INTELECOM goods (e.g., telecourses, telewebcourses, digital media, videos, DVDs, CDs, print materials) and services; to support partner districts of the Southern California Consortium for Community College Television; and to disseminate information related to distance learning and related best practices in higher education, adult education and secondary education.

Permitted Uses of Content on iTunes U
INTELECOM content on iTunes U Beyond Campus (“iTunes U”) is made available to Users for non-commercial purposes only as described below. Users acknowledge that they in no way acquire any ownership rights by downloading or embedding copyrighted material.

Viewed Online – Users are permitted to view the Content from iTunes U only.

• Download and View – Users are permitted to download the Content from iTunes U to view on a computer or other digital video device for personal use.

• Download and Share – Users are permitted to download and share the Content from iTunes U, unmodified, into a presentation (such as a PowerPoint or Web page) and for educational purposes only. Users acknowledge and agree that they may download and share the Content from iTunes U provided only that the following statement is prominently displayed with the Content: “Used with the permission of INTELECOM Intelligent Telecommunications.”

Content from iTunes U may not be altered, transformed or built upon (no derivative works) or used in a way that disparages the original purpose and intent of the Content. Watermarks, title names, logos, and credits within the Content may not be edited, removed or obstructed. iTunes U is a trademark of Apple, Inc. registered in the U.S. and other countries.

Permitted Uses of Content on YouTube
INTELECOM Content on YouTube is made available to Users for non-commercial purposes consistent with the terms and conditions of the Standard YouTube License.

Disclaimer of Warranties
Users acknowledge and agree that access to, and downloading of Content from, the Website is at their sole discretion and risk. Users further agree that the Website, and all Content as may be made available on the Website, is provided on an “as is” and “as available” basis. INTELECOM makes no warranties or representations of any kind whatsoever regarding the Website or the Content. By way of example only, and without limiting the foregoing, INTELECOM makes no warranty or representation that (i) the Website or Content made available on the Website will meet Users’ requirements; (ii) the Website will be error free, secure or uninterrupted; or (iii) that goods or services purchased on the Website will meet Users’ expectations.

Limitation of Liability
In no event shall INTELECOM, its partner districts, board of directors, officers, employees, agents or any third-party providers of Content to the Website, and to the greatest extent permitted under applicable law, be liable for any damages, either direct, indirect, special, consequential or incidental, resulting from the use of, or inability to use, the Website, the Content and/or services made available on or downloaded from the Website. This includes but is not limited to lost data, computer failure or malfunction, lost business, or other losses that result from errors, defects, viruses, or any other failure of performance or legal defect of any kind whatsoever related to the Website or Content made available on the Website.

These TOU shall be governed by the laws of the State of California, including its Uniform Commercial Code. These TOU constitute the entire agreement between Users and the Website.
